Why Breach and Termination Notices Matter

One of the key takeaways from our recent NCAT training was the importance of following the correct process when issues arise during a tenancy.
While the majority of tenancies run smoothly, there are times when the obligations and conditions of the lease aren’t being met. Whether it’s rental arrears, property maintenance concerns at routine inspections, or other breaches of the tenancy agreement, it is important that these matters are addressed promptly and in accordance with the legislation.
Issuing a breach or termination notice isn’t about trying to create conflict – it is about ensuring that the correct legal process is followed and that both landlords and tenants are treated fairly. These notices provide an opportunity for issues to be resolved and, if necessary, ensure that the appropriate documentation is in place should a matter have to proceed to NCAT.
Our recent training really reinforced just how important accurate record-keeping, clear communication, and actions such as issuing breach notices are when managing tenancy issues. We often find that landlords are hesitant to issue breach notices or termination notices, however by following the correct procedures from when the initial breach is noted, we can better protect our clients interests while ensuring compliance with current tenancy legislation.
It is also important to note that failure to issue breach and termination notices could impact some landlord insurance policies as well.
